A 31-year-old security guard, Awujoola Olayinka, charged with stealing N136,000 with his neighbour’s ATM card, on Monday appeared before an Apapa Magistrates’ Court, Lagos.
Olayinka, who resides at No. 18, Iganmu St., Olodi-Apapa, Lagos, is facing a two-count charge of conspiracy and stealing.
The prosecutor, Cpl. John Iberedem, told the court that the accused committed the offences on Aug. 7 at the same address.
Iberedem said the accused conspired with another person, now at large, and stole an ATM card belonging to one Roseline Oguntimiloyin.
He said the accused used the ATM card to withdraw N136, 000 from Oguntimiloyin’s bank account.
Oguntimiloyin said the accused was the only one who knew her password because he was with her the first time she used the ATM card.
“The bank was able to identify him as the culprit,” Iberedem said.
The prosecutor said the offences contravened Sections 285 and 409 of the criminal Law of Lagos State, 2011.
Olayinka, however, pleaded not guilty to the charges.
The Section 285 prescribes three-year jail term for stealing while Section 409 stipulates two years imprisonment for conspiracy.
The Senior Magistrate, Mr Patrick Adekomaiya, granted him A N30, 000 bail, and one surety in like sum.
Adekomaiya adjourned the case till Sept. 22 for trial
